TERMS OF SERVICE FOR DAVO REFERRAL PROGRAM WITH TOAST

Get rewarded for spreading the word about DAVO! Refer a restaurant and receive a bonus for every qualified lead passed along. Please review the legal terms below before submitting a referral. 

Who is Eligible to Participate? 

Toast employees and consultants – who submit a lead via a valid @toasttab.com email address – who refer a restaurant to DAVO through the online referral form or in writing to a DAVO employee may be eligible to receive a $25 lead referral bonus for 1-4 locations or a $50 lead referral bonus for 5+ locations; or $100.00 if referral becomes an Active DAVO paying customer; or $150.00 if you board your Qualified Referral. 

Who is Not Eligible to Participate? 

Anyone who is not a Toast employee is not eligible to participate. 

Offer Timeline 

This offer is valid for referrals sent between November 1, 2023 and June 30, 2024. Leads will be qualified no later than July 31, 2024. 

Referral Requirements 

Subject to these Terms, for each “Qualified Lead Referral” that meets the following criteria, you will receive the applicable Bonus Payout listed below. A “Qualified Lead Referral” is a restaurant that: 

• is referred to DAVO either through the online referral form, or in writing (email is acceptable) to an existing DAVO employee, verbal referrals are unable to be verified and will not be accepted; 
• is not an existing lead in the DAVO system (DAVO reserves the right in its sole discretion to determine the original lead source. Exceptions may be made, in DAVO’s sole discretion, if the referral has not been contacted by DAVO for at least 6 months); 
• has either 1) booked a demo with a DAVO representative OR 2) has signed up for DAVO’s sales tax service using DAVO’s self-boarding registration platform. 
• “Active DAVO paying customer” means the Qualified Lead Referral has moved beyond the first free filing and has paid DAVO for their first month after free filing. 
• “Toast Employee Onboards” means the Toast employee helps their customer sign up for DAVO and become an Active DAVO paying customer. Requires notification within 24 hours of boarding the client by submitting referral with comment that you have boarded them or posting customer details in slack channel, ext-toast-davo.

Bonus Payouts 

A lead referral bonus of: $25 for 1-4 locations or $50 for 5+ locations will be paid out for each Qualified Referral OR $100 if your Qualified Referral becomes an active DAVO paying customer OR $150 if you board your Qualified referral.

• Bonus payouts will be paid by Toast. There will be a line in your paycheck showing a referral payment from DAVO, DAVO Sales Tax, or DAVO Technologies. 
• There is no limit to the number of referrals an individual can submit, or eligible Bonus Payouts for Qualified Lead Referrals, Active DAVO paying customer, or Toast Employee Onboards, an individual can receive, while the Program is effective. 
• DAVO will determine, in its sole discretion, whether a referral is a Qualified Lead Referral, Active DAVO paying customer, or Toast Employee Onboards, eligible for a Bonus Payout. We review lead referrals monthly. If your referral lead qualifies for a Bonus Payout, DAVO will email you to let you know. 

Modifications 

DAVO reserves the right to modify these Terms or terminate the Program at any time, in its sole discretion, without notice, however we will employ commercially reasonable efforts to post a notice on the referral website.
